2 convicted of possession of fire armMonday, August 30, 2010 Two men; namely Modou Krubally and
Grigare Njie, all Gambians, were on Tuesday convicted and sentenced by
Senior Magistrate Abdoulie Mbacke of the Bundung Magistrates Court. They were
charged with two counts: count one, being in possession of fire arm contrary to
Section 8 of the Arms and Ammunition Act Cap 10 Volume III laws of The Gambia
and count two, reckless and negligent act contrary to Section 222 (C) of the
Criminal Code Cap 10 Volume III laws of The Gambia.
According to the particulars of the offences, on the 7th of August 2010 at Yuna Village in Kombo North, the accused had in possession a local gun without licence or authority and on the same day and place in the year 2010, the accused recklessly and negligently fired at the villagers and a bullet wounded one Isatou Jallow, causing her injury, thereby committed an offence.They all pleaded guilty to the charges. In their plea of mitigation, the accused persons told the court that it was not their intention to commit an offence, saying: "We have a family to take care of, it was indeed an accident. We are ordinary farmers." Delivering his judgment, Senior Magistrate Mbacke told the court that the accused merit some punishment. He said the fact revealed by prosecution on the 7th of August 2010 at Yuna Village, stated that the two were found with local gun without obtaining valuable document and the first accused lent the said gun to the second accused, Grigare Njie, who was going to hunt for a bush fowl. When the second accused fired at the bush fowl, one bullet landed on the fore head of one Isatou Jallow, who was fetching water at the well and the bullet caused her an injury. The magistrate explained that the victim was later treated at the Sukuta Health Center. Mbacke stated that the law prohibits both locally made and western made guns, without valued licence or authority, adding that the accused committed two offences at one time. "You may be ignorant of the laws, but cannot stand for excuse; the need for government to control guns cannot be over-emphasised," he told the court. Mbacke told the court that the accused were brave to admit guilt, but deserve a degree of punishment. The first accused was sentenced to pay a fine of D,500 in default to serve one month imprisonment. Meanwhile, the second accused was sentenced to pay a fine of D200 in default to serve one-week imprisonment and he was ordered to pay a compensation of D150 to the victim in default to serve another one week imprisonment.
