Manlafi's bail review application rejected

africa » gambia » banjul
Tuesday, March 18, 2008
Senior magistrate Kayode Olajubutu of the Banjul Magistrates court recently rejected the bail review application made by lawyer Lamin Camara for his client Malafi Sanyang former head of government Vehicle Control Unit at the State House.

Magistrate Kayode in his ruling said lawyer Camara has failed to tell the court how it has become impossible to get a permanent secretary to stand as a surety for the accused.

According to him there are more permanent secretaries in The Gambian  civil service capable to bail the accused. " How does it became impossible to get a permanent secretary to bail the accused?"  he asked.  He further refered to section 99 (2) of the criminal prosedure code, which he said provides that the amount of bail shall be fixed with due regards to the circunstances of the case and the defence application shall not be an excuse, magistrate Koyode said.
