4 convicted of multiple offencesWednesday, April 11, 2012 Four persons, namely, Alhagie Sissoho, Kally Bah, Morro
Saidy Bah and Cherno Sissoho were on Monday convicted and sentenced on four
counts of criminal offences, ranging from obtaining money by false pretence, to
conspiracy to commit felony, obtaining money by false pretence and conspiracy
to commit felony, all contrary to the Laws of The Gambia.
On count one, the particulars of offence revealed that between October 2007 and August 2008 at diverse places within the Kanifing Municipality, through false representation, the accused persons obtained the sum of D1, 430, 000 from one Musa Trawally, by telling him to invest into business, which will yield him big profit in a short period of time, which representation they knew to be false. On count two, the particulars of offence revealed that between October 2007 and August 2008 at diverse places within the Kanifing Municipality, the accused persons conspired to defraud Musa Trawally in the sum of D1, 430, 000. On count three, the particulars stated that in the same month, at the same place and at diverse places within the Kanifing Municipality, the accused persons through false representation obtained the sum of D47, 000 from one Haji Drammeh by telling him that they run a lucrative business which representation they knew to be false, thereby committed an offence. While on count four, the particulars of offence revealed that between October 2007 and August 2008 at diverse places within the Kanifing Municipality the accused persons conspired to defraud Haji Drammeh in the sum of D47, 000, thereby committed an offence. During the trial, the prosecutor handling the case, Inspector Touray called three witnesses while the accused persons defended themselves without calling any witness but however the prosecution was able to prove their case beyond reasonable doubt to secure the conviction of the accused. Sentence The accused persons were sentenced to pay a fine of D20, 000 each on all the counts or in default to serve a term of imprisonment of six months to each sentence of a fine.
