Alleged fraudster’s appeal struck out

The presiding judge, Justice Joseph Wowo of the High Court in Banjul last Wednesday struck out the notice of appeal filed by one Pa Mammar Sinyan.

Pa Mammar Sinyan is alleged to have issued an Access Bank Cheque No; 00138900 with face value of D33,000 to one Issan Bazzi knowing that there is no sufficient funds in his account. The accused appeared before Magistrate Emmanuel Nkea of the Banjul Magistrates Court on charges of issuing a dishonoured cheque, contrary to Section 29 (A) of Decree No 86 of the Criminal Code Amendment Decree 1996.

The appellant is asking the High Court to set aside the ruling of the Lower Court and urged the High Court to acquit and discharge him. When the matter came up on Wednesday, both the appellant and his legal counsel were not present in the court. Justice Wowo disclosed that since the appellant and his counsel were not present, it shows that they are not serious in pursing their appeal. The notice of appeal was therefore struck out.
