Alleged thief acquitted, dischargedFriday, August 17, 2012 Magistrate Isatou Janneh of the Bundung Magistrates’ Court on Monday, 13th August 2012, acquitted and discharged one Bassa Gaye on the grounds that the prosecution did not prove its case beyond reasonable doubt. The accused was charged with one count of stealing and the facts of the charge stated that on March 22nd 2012 at Tallinding in the Kanifing Municipality, the accused stole an amount of D20, 035 from one Madlen Bass, a charge he denied. During the trial the prosecution called two witnesses and tendered two exhibits in support of their case while the accused testified as a lone witness. The presiding Magistrate in her ruling said the court being one of law and facts the admonition to the jury above is applicable. In light of the above and from the totality of evidence before this court, he found and hold that the prosecution has failed to prove their case beyond any reasonable doubt as required by law.
