Bambara speaking robber delays own appeal

Justice Wowo of the high court in Banjul, yesterday warned one Omar Jaharteh of delaying his own appeal.

Justice Wowo made the remark when the appellant disclosed that he cannot speak or understand any language but Bambara.
Justice Wowo revealed that the record of proceedings from the lower court had indicated that the appellant speaks and understands Mandinka.
Justice Wowo said the accused should not waste the court's time by saying he only understands Bambara. Justice Wowo further said the appeal can only proceed if a Bambara interpreter is available.

The appellant was convicted and sentenced on two courts of attempted rape and robbery with violence on October 15, 2008 by the Brikama Magistrate Court. It was revealed that it happened on 21st September 2008, between 8.00-8.30pm. The complainant was said to have been  travelling through the bush when the convict emerged, violently gripped her and pulled her down to the ground and attempted to ahve carnal knowledge of her.

It was also revealed that the complianant then managed to escaped but as she was trying to escape, the convict forcefully took her bag, containing a cheque, from her and she then reported the matter to the Gunjur police station. Unfortunatley for the convict, on October 8, 2008, the compliainant saw the accused and shouted for help and stated that the convict was the one who attacked her.

He was arrested and taken to Gunjur police station. The appellant was given 5 years imprisonment on each of the counts.  The matter was adjourned to October 5, 2009.
