Abeke of the Banjul Magistrates Court. When the matter was called yesterday, the deputy director of Public Proscution, Mikailu Abdullahi recalled that on the last sitting, the matter was adjourned for the accused persons to take their plea. He further recalled that he did on that occasion inform the court of their intention to amend the charge against the accused persons in order to see more important and comprehensive charges. The DDPP then informed the court that they have prepared 12 counts ready for filing. "My lord, in the circumstance, I am proposing two things, one; to take the plea of the accused persons on the one-count charge before the court so that on the next adjourned date that charge will be substituted with the 12-count charges. In the alternative, my lord, the court can see what to do with regards to what I have said, that is if the matter can be adjourned so that it will enable us to carry a new charge against the accused persons," he stated. Responding to the DDPP, defence counsel E.E Chimeh who represented the 8th,9th,10th and 12th accused persons, said they have no response but to leave it to the discretion of the court. Defence counsel Lamin S Camara, who is representing the 1st, 2nd,3rd,4th, 5th, 6th, 7th and 11th accused persons, in responding to the DDPP, said he is not opposed to coming back on a very short date for the accused persons to take their plea. He explained that what he is after is not to take a long adjourned date. "On the contrary, I am suggesting your worship that this court orders that the incoming charge sheet be stamped and handed over to the court clerk," he stated, pointing out that since there is going to be a substitution of a charge, the previous records will be of no relevance in the subsequent proceedings. He added that justice delayed is justice denied. The matter was then adjourned to Tuesday 7th and Thursday 9th of September 2010 to enable the state file the new charges and the accused persons to take their plea. Author: by Ebrima M.
