Court dismisses another drug convict's appealTuesday, August 31, 2010 Justice Emmanuel Amadi of the High Court in Banjul has dismissed the criminal appeal case
involving one Amadou Saidy versus the state. The appellant, Amadou Saidy was convicted and sentenced to seven years imprisonment or in default to pay the sum of D500, 000 as fine to the state by the Banjul Magistrates Court, presided over by acting Principal Magistrate Hilary Abeke for the offence of trafficking prohibited drugs, contrary to the Drug Control Act 2003, laws of The Gambia. The appellant, dissatisfied with the lower court's decision, filed an appeal challenging the said decision. In his notice of appeal, the appellant indicated that he pleaded guilty to the charge but was seeking the court's power to reduce the said sentence imposed on him by the lower court. In his response, Principal State Counsel, S H Barkun, advanced that the appeal lacks merit citing Section 272 of the CPC to back his point, and urged the court to dismiss the said appeal. He indicated that the appellant pleaded guilty to the charge and had not advanced any reason for his appeal.
