Court strikes out cattle thief's appeal

Justice Emmanuel Amadi of the High Court in Banjul, yesterday struck out a criminal appeal case filed by one Sheikh Omar Sowe, a prisoner at the Mile II State Central Prisons.

Sheikh Omar Sowe was convicted and sentenced to serve two years jail term by the Brikama Magistrates Court for the offence of cattle stealing.The appellant in his notice of appeal, admitted that he is guilty of the offence, but was begging the court for leniency and reduction of the sentence imposed on him by the lower court.

After perusing the notice of the appeal filed by the appellant, the presiding judge, Justice Amadi queried on what ground would he reduce the appellant's sentence.At that junction, the principal state counsel, S.H Barkun, indicated that there is no provision in the Criminal Procedure Code indicating that there is leniency and reduction of sentence on appellants.

S.H Barkun advanced that begging for court leniency and reduction of sentence is no ground of appeal and therefore urged the court to dismiss the appeal.Meanwhile, Justice Emmanuel Amadi struck out the appeal as it lacks merit.
