D835,000 ‘fraud’ case in courtMonday, July 16, 2012 One Kenny Sambou on Friday, 13th July 2012 testified as the first prosecution witness (PW1) before Magistrate Landing Sanneh at the Bundung Magistrates’ Court, in the case involving one Amadou Bojang, who is standing trial for allegedly obtaining money by false pretence, contrary to the laws of The Gambia. The particulars
of the offence stated that in the year 2010 at Brufut, in the Kombo North, West
Coast Region, the accused person obtained the sum of D835, 000 from one Kenny
Sambou, with the pretext of purchasing a truck for him from Germany, having
reason to believe that such representation was false, thereby committed an
offence. When the charge
was read to the accused person, he pleaded not guilty. Sgt 1883 Bojang stood
for the IGP. In his testimony, PW1 told the court that he could remember the accused person and that could recall in the year 2010 at Brufut he gave D835, 000 to the accused for the purchase of a truck. He said the accused told him that his father was in Germany and he would buy the truck for him (PW1). The witness said after one year, he didn’t see any truck. PW1 further
told the court under cross-examination that when he was giving the accused the
money, the accused signed for the money and that he (the witness) would
recognise the letter signed by the accused. At that juncture, the presiding magistrate ordered that the said letter be shown to the witness for identification, which the witness identified and it was tendered and marked as Exhibit (A). PW 1 reiterated that he told the accused to buy for him a Benz truck but since then he neither saw the truck nor the money he gave to the accused. When the magistrate put the testimony of the witness to the accused, the accused denied it, saying he did not tell the witness that he would buy for him a truck, instead the witness came to his compound and saw a truck there expressed his want of a truck, and he told him (the witness) that he had a truck to sell.
