Defence applies for review of bail condition

Africa » Gambia
Monday, March 08, 2010
Lawyer Antouman Gaye, counsel for Christopher Badjie, last Thursday, March 4th made an application for review of the bail condition for his client at the Special Criminal Court presided over by Justice Moses Richards.

The defence counsel submitted that there is need for the accused to stop reporting to the offices of the NIA as he is on court bail. He also submitted that the NIA should return certain items seized from the accused during the course of the investigations. Mr Gaye applied for the court to activate the bank accounts of the accused as they were frozen, which made it impossible for the accused to access his fund. DDPP Mikailu Abdulahi informed the court that the state has filed a 20-paragraph affidavit in apposition to the application for a review of the bail conditions of the accused.

The matter was adjourned to March 10, 2010 for the Special Court to hear the application.  It would be recalled that the state filed an application for writ of certiorari to quash the proceedings and ruling of the Banjul Magistrates Court delivered by the then Principal Magistrate B.Y. Camara.
