Defence submits 'no case to answer'

Neneh Cham Chongan, counsel for Isatou Jallow, yesterday, March 9th made a ‘no case to answer’ submission before Magistrate Abdoulie Mbacke of the Kanifing Magistrates Court.

The accused, Isatou Jallow, was charged with two-count offences of shopbreaking and stealing, contrary to the laws of The Gambia; charges to which she pleaded not guilty. When the matter was mentioned, the defence counsel submitted that her client has no case to answer on the ground that there is no sufficient evidence against the accused and hence the need for the court to discharge and acquit her.

The defence council told the court that the evidence given by the prosecuting witnesses are highly insufficient, inconsistent and unreliable with reference to the evidence of both PW1 and PW2. Police Prosecutor Mballow objected to the submissions made by the defence and therefore urged the defence to open their defence. Magistrate Abdoulie Mbacke then adjourned the case to the 5th of April  when the no case submission by the defence council will be set for ruling.
