Defendant ordered to pay D40, 000 to plaintiff

Magistrate Landing M. Sanneh of the Bundung Magistrates’ Court Wednesday ordered one Modou S. Cham, a defendant to pay an amount of D40, 000 to the plaintiff, Sainabou Jallow, being an outstanding balance of monies owned to the plaintiff by the defendant.


Sainabou Jallow is claiming an amount of D40, 000 and the particulars of claim revealed that the plaintiff claimed an amount of D40, 000 being an outstanding balance of monies owned to her by the defendant when the plaintiff sold the defendant a motor vehicle at a tune of D120, 000 and the defendant paid an amount of D80, 000 remaining a balance of D40, 000.


The defendant pleaded guilty to the charge and the magistrate in his ruling stated that since the defendant has admitted liability for the sum of D40, 000 the court hereby entered judgement in favour of the plaintiff for the sum of D40, 000 with cost of D1, 000 to be paid to the plaintiff by the defendant. The magistrate further ordered that the defendant should provide two Gambian sureties.
