Gunjur murder case set for judgementWednesday, March 10, 2010 Justice Moses at the Special Criminal Court, on Monday, March 8th adjourned the case involving one Lamin Faye for judgement; the date of which will duly be communicated to the parties to the matter. This development came after addresses were made by both the prosecution and the defence counsel, Assan Martin. The accused is alleged to have caused the death of one Mustapha Jammeh by stabbing him with a knife on the 12th of June 2009 in Gunjur Village, Western Region. The defence counsel in his address, made a passionate appeal to the Special Criminal Court judge to consider the mental state of the accused at the time of committing the offence as he put it, the accused was suffering from delusion and hallucination, and so the accused did not realise what he was doing. Assan Martin backed up his submission with reference to the cross-examination statements made by the accused and section 10 of the Criminal Code laws of The Gambia, with regards to the mental state of the accused in a criminal trial. The defence also cited series of cases at both local and international level such as the famous Bratty versus the Republic of Northern Ireland case in 1963 and that of Leekman in the 1970s, where a murder charge was substituted with a manslaughter.
