High Court urged to dismiss convict's appeal

State Counsel MB Jones of the Attorney General's Chambers has described the notice of appeal filed by one Vincent Mendy as incompetent.

State Counsel Jones made this declaration before Justice Sallah-Wadda of the High Court in Banjul in the hearing of the notice of appeal filed by the said Vincent Mendy, who is currently serving 12 years of imprisonment for shop breaking and stealing. Lawyer Jones argued that there were some fundamental issues which make the appellant's notice of appeal incompetent before the court.

She said the appellant, in his argument, indicated to the court that he had been previously convicted for another offence before he was convicted by the then Magistrate Mboto of the Brikama Magistrates Court on multiple charges of shop breaking and stealing. Lawyer Jones indicated that the convict was already serving a sentence when he was further convicted and sentenced for shop breaking and stealing in December 2003.

She further said the record of proceeding from the magistrates court referred to a sentence of aggregate of six years, whilst the convict's notice of appeal on the contrary refers to a sentence of 12 years. Lawyer Jones argued that the convict's grounds of appeal that the sentence imposed on him was excessive was baseless. Justice Sallah Wadda latter adjourned to June 24, 2009 for judgement.
