In false information case Accused person denied bail

The sherrif of the High Court in Banjul, Pa Harry Jammeh, yesterday, Thursday 2 July, 2009, presided over a false information case in Brikama. Karafa Sanneh was brought before the Brikama Magistrates Court to answer to the stated charge, to which he has pleaded not guilty.

The prosecution officer ASP Touray, objected to his bail on the grounds that investigations are still going on, and the charges before the court were just holding charges until the prosecution is able to bring proper charges against the accused. The defense counsel, Lawyer Jobateh, however, argued that there is noting like "holding charges in law." He said accused is either charged or not charged. Counsel Jobarted said the only offenses that are unbailable are those that are punishable by death.

The defense lawyer also stated that Count 3 of the charge sheet was vague because the police could not state the names of the people whom the accused gave the false information. He further argued that the prosecution had not shown to the court sufficient evidence to show that the accused, if granted bail, will tamper with the investigation.

In his ruling on the argument, the Hon Sheriff said the court would not give the accused bail at that time, but would do so in the next session. The court urged the prosecution to finish its investigations before the next adjournment. The case was then adjourned to 16 July, 2009.
