Lady testifies in criminal trespass & common assault caseWednesday, April 25, 2012 Hawa Sanyang, a resident of Wulingkama in Kombo North on Wednesday testified ç the first prosecution witness (PW1) in the ongoing criminal trial involving the state against Fatou Faal and Jainaba Gitteh before the Bundung Magistrates’ Court presided over by Principal Magistrate Foster. The two accused, Fatou Faal and Jainaba Gitteh were standing trial on two counts of criminal trespass and assault, both contrary to the Laws of The Gambia. The particulars of offence on count one revealed that on 12th day of February 2012, at Wulingkama, Kombo North District, West Coast Region, the two accused persons entered the compound of one Hawa Sanyang with the intent to annoy her (Hawa Sanyang). While on count two, the particulars of offence revealed that on the same date and time at Wulingkama, the two accused persons jointly assaulted one Hawa Sanyang by beating her all over her body, thereby committed an offense. The accused however pleaded not guilty. Testifying in court, PW1 told the court that she recognised the two accused persons and can recall the 12th day of February 2012 at Wulingkama, while she was at home, the two accused persons came all the way from London Corner in Serrekunda to Wulingkama and insulted her (PW1) and her mother. According to PW1, the accused persons committed such act because she (the complainant) was having problem with the two accused persons’ mother. She narrated briefly her encounter with the accused persons’ mother, which led to her arrest and subsequent detention at the Wulingkama Police Station and then the matter was settled at the station. “After that on the following day, the two accused persons came back home and started beating me all over my body until I got sick,” PW1 told the court.
