Magistrate Mahoney overrules prosecutor's application

The Kanifing Magistrates Court, presided over by Magistrate B Mahoney, on Thursday, overruled the application made by the police prosecutor, Cadet Inspector Mballow to revoke the bail condition of one Bakary Badjie and his brother, Kawsu Badjie.

The duo is facing two charges of assault and criminal trespass to which they have pleaded not guilty. Inspector Mballow made the submission, following the absence of the accused persons. According to him, the duo has not informed the court about the reason for their absenteeism. He told the court that remanding the accused persons will ensure their presence in court.

In his ruling, Magistrate Mahoney told the court that the duo wrot to the court to explain the reason for their absenteeism. He thus refused to revoke their bail on that ground and subsequently adjourned the case to the 24th of June 2009.
