Man denies 208 count charges

Ebrima Gomez who is facing 208 counts of criminal charges was arrainged on Tuesday  at the Bundung Magistrates Court before acting Principal Magistrate Lamin George.

When the case called for continuation, the presiding Magistrate started reading the charge sheet from count 202 where the case was adjourned for continuation. On count 203, he is charged with obtaining money by false pretence contrary to Section 288 of the Criminal Code Cap 10 Volume III. The particulars of offence stated that between the period of January to February 2008 at Kotu Quarry, the accused with intent to defraud, obtained the sum of D200,000 from one Landing Barrow, with the pretext to sell a plot of land to the said Landing Barrow, which the accused  knows to be false or not true.

On count 204, he is charged with obtaining money by false pretence contrary to Section 288 of the Criminal Code Cap 10 Volume III. The particulars of offence stated that on the 3rd March 2003 at Kotu Quarry with intend to defraud, the accused obtained the sum of D5,000 from one Yaya Badjie with the pretext  to sell a plot of land to the said Yaya Badjie, which the accused knows to be false or not true.

On count 205, the accused is charged with obtaining money by false pretence contrary to Section 288 of the Criminal Code Cap 10 Volume III. The particulars of offence stated that sometimes in the year 2003 at Kotu Quarry the with the intent to defraud, the accused obtained the sum of D31,000 from one Bafoday Bah, with the pretext to sell a plot of land, which the accused knows to be false or not true.

On count 206 the accused is charged with obtaining money by false pretence contrary to Section 288 of the Criminal Code Cap 10 Volume III. The particulars of offence stated that between the period of 2006 to 2009 at Kotu Quarry with intent to defraud, the accused obtained the sum of D21,200 from one Veronic Da-sylva with the pretext to sell a plot of land to the said person, which he accused know to be false or not true.

On count 207, he is charged with obtaining money by false pretence contrary to Section 288 of the Criminal Code Cap 10 Volume III.
The particulars of offence stated that sometimes in the year 2008 at Kotu Quarry with intent to defraud, the accused obtained the sum of D5000 from one Bintou Jammeh, with the pretext that to sell a plot land to her, which the accused know to be false or not true.

On count 208, he is charged with obtaining money by false pretence contrary to Section 288 of the Criminal Code Cap 10 Volume III. The particulars of offence stated that some times in the year 2003 at Kotu Quarry with intend to defraud, the accused obtained the sum of D6000 from the following persons; Isatou Jammeh, Isatou Jarjue and Ma Sanneh with the pretext to sell a plot of land to them, which the accused knows to be false or not true.

He pleaded not guilty to all the 208 counts. The prosecutor 1674 Ceesay handling  the case made an application under Section 69 of the Criminal Code, to make an addition of one charge sheet and that is Count 209, which added that the second accused person Saikouba Ceesay attached with the consent from the Attorney General’s Chambers dated 18th January 2010 singed by Attorney General.

On count 209, the second accused is charged with abuse of office contrary to Section 90 of the Criminal Code Cap 10 Volume III. According to the particulars of offence, sometimes in the year 2005 at Kotu Quarry the second accused, Saikouba Ceesay being the debt collector at sales and tax collection office in Kanifing Municipal Council, abused the office and assisted the first accused; Ebrima Gomez, with no proper  compound documents. He also pleaded not guilty. The case was adjourned to 26 May 2010.
