MRC doctor wins land case

The Bundung Magistrates Court, presided over by Acting Principal Magistrate Kumba Sillah-Camara, on Tuesday, delivered judgment on a civil suit filed by Dr Assan Jaye of the Medical Research Council (MRC) against Sait Mboob, a real estate agent.

Dr Assan Jaye was claiming for the recovery of D200,000 -being the price for a plot of land; D30,000 - for the preparation of documents for the said plot of land; and D12,000 -which was meant for the fencing of the said property, from the defendant.

Testifying before Acting Principal Magistrate Kumba Sillah-Camara, Dr Assan Jaye, a resident of Bijilo and a medical scientist, informed the court that on 24 January 2007, he purchased a plot of land near the Banjul International Airport at a cost of D200,000 from Sait Mboob. He added that he also gave the defendant D30,000 plus another D12,000 in the presence of an independent witness, when they signed the documents for the purchase of the land.

Dr Jaye further stated that he later learned that the land in question does not in fact belong to Sait Mboob. At that juncture, his lawyer, Baslou Conteh, presented the documents detailing the transaction, which were tendered  and marked as exhibits. Magistrate Kumba Sillah-Camara then delivered judgement in favour of Dr Jaye.

She ordered the defendant (Sait) to refund the MRC doctor D242,000.  He was also order to pay the plaintiff D50,000 for breach of contract, plus 30% interest and D2000 for cost of  litigation.
