Murder suspect's relatives reluctant to prosecuteSaturday, August 29, 2009 The criminal trial of one Basirou Baldeh resumed on Tuesday August 25, 2009 before Justice Moses Richards of the special criminal court in Banjul. The accused was alleged to have unlawfully caused the death of his brother, Babucarr Jallow by hitting him with a hard object on October 20, 2008 at Angerfuta village in Basse, URR. Two prosecution witnesses have so far testified before the court: Police Superintendent Lamin Keita and one Abu Taal, the sibling's uncle. At the last sitting, principal state counsel, SM Barkum initmated the court that there is a proposal for a plea bargain in this case by the defence counsel lawyer Amie Joof-Conteh. Lawyer Barkum informed the court of the prosecution's readiness to proceed with the hearing of the case, but lamented the fact that the accused's relatives are saying that they cannot come to the court to prosecute the accused person. Lawyer Barkum quoted them as saying, "one has died, why should they send the other one away for life". Principal State Counsel Barkum noted that the deceased is a brother to the accused. Justice Richards however ordered the court clerk to send a hearing notice to the defence counsel, Amie Joof-Conteh and urged that she sent her plea bargaining proposal to the court so that the court and parties involved would dialogue on it.
