Narcotics agents' trial progresses As PW1 testifies

Africa » Gambia
Wednesday, September 01, 2010
Dodou Bojang, a narcotics agent attached to the Sibanor Police Station on Tuesday testified against two of his colleagues standing trial on five counts charges before Magistrate Nkea of the Brikama Magistrates Court.

The two accused persons, Jerreh Jarju and Samba Camara are charged with official corruption, public officers receiving property to show favour, abuse of office, conspiracy to commit misdemeanour and destroying evidence. In his evidence-in-chief, Dodou Bojang (PW1) said in the month of May 2010, while he was on official duty at the charge office as a narcotics officer, the first accused Jerreh Jarju called him and told him to go behind the window. He said when he went behind the window as the first accused instructed, the latter gave him a wrap of cannabis and instructed him to throw it into the suck away.  "I said to him, sir this is cannabis and he said to me throw it out which I did," he added.

PW1 disclosed that he informed one Modou Sanneh, an Immigration officer about the matter. He also told the court that on 18th June 2010, he received a telephone call from the first accused informing him that there will be an investigation into the matter and advised him not to open his mouth under any condition. During cross-examination by Lawyer Kebba Sanyang, the counsel for the first accused, PW1 informed the court that he was working under the first accused as a first class and he is still a first class.

PW1 also said he cannot tell the court the quantity of the said cannabis, but that he opened it while it was wrapped in a cement paper. He admitted he only identified that it was cannabis but did not put it through any scientific test, which he said is the standard procedure of identifying cannabis or any other drug. Lawyer K. Sanyang put it to him (PW1) that he cannot say it was cannabis when it was not subjected to any scientific test and added that he was spoon fed to come and testify against the accused persons. The witness strongly denied that he was spoon fed to testify against the accused person.

When asked as to why he (PW1) did not arrest the first accused for being in possession of drugs, he replied that the first accused was his boss, and so he could not arrest him. Sanyang finally put it to PW1 that the first accused did not give him anything to throw away, but PW1 maintained that the first accused gave him cannabis to throw away. The presiding magistrate gave his ruling on the bail of the accused persons and said he doesn't admit the bail of the accused persons. He then adjourned the case to 6th September 2010 for continuation of cross-examination of PW1 by Lawyer L.S Camara for the second accused Samba Camara.
