Negligent driver convicted

One Kujay Taal was on Monday arraigned before Magistrate Nkea of the Brikama Magistrates Court, charged with rash and negligent driving causing death.

According to the particulars of the offence, the accused on 19th August 2010 at Yundum in the Western Region of the Republic of The Gambia, drove a motor vehicle with registration number BJL 6868 C in a rash and negligent manner, and thereby caused the death of one Omar Ndow.

When the charge sheet was read to the accused, she pleaded guilty. In her plea of mitigation, the accused urged the court to temper justice with mercy, adding that it was not her intention to knock down the deceased. Magistrate Nkea however, in his judgment convicted and sentenced the accused to pay a fine of D5,000 in default to serve 18 months imprisonment. He also suspended the accused from driving for a period of three months.
