Police assigned to produce murder suspect

The Special Criminal Court (SCC) presided over by Justice Emmanuel Nkea, yesterday, April 23rd 2012, made an order for the Gambia Police Force bring to the SCC, one Ebrima Bojang, who has been charged with murder, contrary to the laws of The Gambia.

The High Court judge’s decision followed an application for adjournment by the deputy director of Public Prosecution, SH. Barkun, on the grounds that the accused was nowhere to be seen, despite being on a police bail. This application made the presiding judge to condemn what he called occasional granting of police bail to murder suspects, which according to him did not conform well with laws relating to people charged with capital offences, especially murder.

The judge, further condemning the police bail to the accused, said the accused had even admitted the offence, but yet still he was granted bail, despite the offence of murder is involved.

According to the judge, the police should not grant bail to even those charged with manslaughter, much more a person charged with murder. He therefore urged the deputy director of Public Prosecution, SH Barkun to work with the police and bring the accused person to the court on or before the next adjourned date, 30th April 2012.
