Proceed or I will close your case - Magistrate Sillah-Camara to litigant

The Bundung Magistrates Court, presided over by Principal Magistrate Kumba Sillah-Camara on Wednesday urged the prosecution in the D1.3 million theft case involving the State and two NIA officers, Demba Sowe and Babucarr Jallow, to proceed with their case or the court will close their case come the next adjournment  date.

The duo are standing  trial on eight charges including theft, conspiracy and abuse of office. Appearing for the prosecution, State  Counsel Barkun told the court that the prosecution needs time  to compile the summary of the proof of evidence of its witnesses as they will very soon serve the defence counsel with  the  proof  of evidence.

Lawyer Lamin Camara, counsel for the accused persons - who walked in late, objected to the application filed by the prosecution. According  to him, the prosecution had not obeyed the court's order as two weeks have elapsed without them (the defense) being served with the proof  of evidence.

He urged the court to take judicial notice of the fact that his client were being remanded at the State Central Prison and that they have the right to fair trial  within a reasonable period of time. Magistrate Kumba Sillah-Camara later adjourned the case to July 7, 2009.
