Sanchaba Sulay Jobe two acquitted, discharged

Acting Principal Magistrate Kumba Sillah-Camara of the Bundung Magistrates Court last Tuesday, acqitted and discharged two residents of Sanchaba Sulay Jobe; namely  Kutubo Tunkara and Omar Ceesay.

They were facing two count charges of stealing and assaulting one Sainabou Jatta of which they earlier denied. Magistrate Sillah-Camara made this ruling following a no-case submission by the accused persons' counsel, Lawyer Ousainou Darboe. In her ruling, Magistrate Sillah-Camara revealed that the prosecution had called three witnesses to back up their case before closing their file on the matter.  She told the court that this was followed by a counter submission file by the defence, Counsel Lawyer Ousainou Darboe of which the prosecutor, Cadet ASP Jahateh, had not replied to.

According to her, the evidence adduced by the prosecution witnesses were discredited under cross-examination by the defence lawyer, Ousainou Darboe. She added PW1, PW2, PW3 never stated in his evidence that he saw the first or the second accused person stealing from the dwelling house or assaulting Sainabou Jatta.  She went on to state that all the evidence from the prosecution witnesses was merely based on hear-say. "No reasonable court of law can rely on this evidence to convict the accused persons as the facts of the charges were not supported by the evidence of the prosecution witnesses.
Magistrate Kumba Sillah Camara then ruled under section 166 of the Criminal Procedure Code (CPC) to aquit and discharge Kutubo Tunkara and Omar Ceesay.
