State objects to bail for Durumakollon robbery suspectsWednesday, March 10, 2010 Ebrima Jah, state counsel, on Monday, March 9th made an application before Justice Moses Richards at the Special Criminal Court, objecting to a bail for three accused persons: Yankuba Jatta, Dab Joof and Saikou Gaye, facing trial on charges of conspiracy to commit felony and attempted robbery. The accused persons were alleged to have conspired, whilst armed with a wooden gun, a cutlass and a knife at a checkpoint in Durumakolon area in Brikama, on the 27th of September 2009. They were alleged to have attempted to rob one Landing Jammeh by the use of threats and force. The state argued that the prosecution has made it clear that the accused persons attempted to assault the complainant, Landing Jammeh, by being armed with dangerous weapons and pointed out that the accused have a case to answer. He added that the offence committed is punishable with death, hence the need to refuse them bail. LK Mboge, counsel for the accused responded to the submission of the state counsel by saying that there is no evidence before the court indicating that the accused have indeed committed the offence. He submitted that the accused are just mere suspects not yet proven guilty to the offence and therefore they are entitled to a bail, which according to him is part of their constitutional rights. In addition to that the defence counsel said the accused persons have sureties once a bail is granted. The matter is adjourned to the 15th of March for ruling.
