Sukutarians in court for ‘land grabbing’

One Marianna Sybesma Loovenga, a Dutch and Cherno Jallow plaintiffs have filed a civil suit against one Modou Jegne and Salifu Colley residents of Sukuta Village, before Justice Fatima Mama Singhateh of the High Court in Banjul.

The plaintiffs informed the High Court declaration that they are the lasses and are entitled to a plot of land situated at Sukuta Village, Kombo North District, bearing serial registration number K2/2005. The plaintiffs are also seeking the High Court to grant injunctions restraining the defendants; Modou Jagne and Salifu Colley, whether by themselves, from trespassing on the said plot of land by building there on, alienating or otherwise interfering with the said leasehold land.

The plaintiffs are also asking the High Court to award them the costs and damages against the defendants for trespass. According to the affidavit sworn to by the plaintiffs, the 1st defendant is presently constructing a building on the said land in Sukuta through his father, Mustapha Jagne, who is supervising the construction. The affidavit also disclosed that the 1st plaintiff met the 2nd defendant when she first came to The Gambia in 1999, when he was a poor man, an unsuccessful bumster. He said she took pity on him and started rendering financial assistance to him.

The affidavit further disclosed that the 1st plaintiff then bought a Peugeot saloon 505 vehicle at the sum of D38, 000 in the name of the 2nd defendant and gave it to him on the condition that he should be paying the sum of D500 per month to the 1st plaintiff, until the purchase price of D38, 000 was completed and the 2nd defendant accepted but never paid anything to the plaintiff.

The affidavit stated that the 1st plaintiff later went back to Holland and when she came back in 2001, she bought the suit land from one Momodou Hajara Cham in the sum of D52, 800 in the presence of one Morikebba Cham, who was the son of the then alkalo of Sukuta and was then functioning as the acting alkalo of Sukuta under the instruction and direction of his late father, the then alkalo of Sukuta.

The affidavit finally disclosed that the 1st plaintiff fenced the land, did the foundation for the construction of building on the land, dug a well and constructed a house for the gateman.
