In traveller's cheque case Defence submission overruledSunday, November 11, 2007 Magistrate BY Camara of the Banjul Magistrates' Court, on Wednesday, overruled the no case submission made by Lawyer Borry Touray, Counsel for Karamba Danso.
The accused is standing trial for allegedly being in possession of 42 traveller's cheques without authority, contrary to Section 298 Cap 10 Volume III, Laws of The Gambia.
Magistrate Camara noted that to prove a no case submission, the defence should be able to clearly provide evidence that the prosecution has no case. He consequently ruled that the court is of the belief that the accused has a case to answer with regards to the charges against him. According to the statement of the offence, Mr Danso is alleged to have been in possession of stolen property (traveller's cheques) on July 11th, 2007 at the Trust Bank Head Office in Banjul, knowing that the cheques were stolen abroad, thereby commiting an offence.
