Land battle hits Brikama court

Manlafi Touray, a businessman in Abuko Village, recently filed a civil suit before Magistrate EF M'Bai of the Brikama  Magistrates Court, against one Babansu Sanyang, involving two pieces of land at Tujereng Village, Kombo South.

According to the claim sheet, Mr Touray, the complainant, is claiming for the repossession of a piece of land situated at Tujereng Village measuring 72m x 63m and 50 m x 64m, valued at D350,000. Mr Touray is also said to be claiming for the repossession of another piece of land that is situated at the same village, measuring 72m x 49.5 and 74m x 52m, valued at D350,000.

The complaint was also claiming for compensation for damages and cost, amounting to D18,500. However, Babansu Sanyang, the defendant, denied all the liabilities levelled against him by Mr Touray, and he denied having any piece of land at Tujereng. He told the court that he only has a land in Sanyang Village, which is being developed.

But Manlafi Touray argued that he had bought the two pieces of land from one Falang Suso on 10th March, 2007. He said one week after the acquisition of the plots of land, he instructed some men to fence one of them with logs. He told the court that in April 2007, he was later informed that someone had removed the logs from the land. "I was also informed that the site was burnt by an unknown person," said.

He told the court that he later tasked some people to search for the person responsible, but he was told the following day that the defendant had instructed some people to remove the logs. But Babansu Sanyang, again denied any liability.

Magistrate M'Bai then adjourned the case to June 9 for him to accompany the parties to visit the site in question.
