Counsel Cross-Examines PW2 in Trespass Trial




Lawyer Makaty, the defence attorney of Musa Jawara, a man who is facing charges of trespass and assault last week Cross-Examined Maimuna Ceesay, the complainant and second prosecution witness (PW2) in the trial before Magistrate Isatou Janneh at the Brikama Magistrates’ Court.

During her testimony in the last hearing of the case, Maimuna identified herself as the ex-wife of the accused person. She recalled that on 17th December 2015, the accused handed her a divorce letter in the month of Ramadan following the assault case.

Musa Jawara is accused of unlawfully entering into Maimuna’s house with intent to intimidate, insult or annoy her on or about the 17th December 2015 at New Yundum village. He is also said to have wilfully and unlawfully assaulted one Ismaila Ceesay on the same day. He has pleaded not guilty to both charges.

During Cross-Examination by Counsel Makaty, Maimuna said Jawara divorced her after her co-wife’s son Ousman Jawara poured water on her (Maiumna’s) child.

She said when the incident happened, the accused person was not at home but upon his arrival, she (Maimuna) cautioned him to talk to her (Maimuna’s) co-wife because her son had poured water on her (Maimuna’s) child and when she tried to advice both children to be one, the co-wife insulted her.

She said after explaining the matter to the accused person (their husband), he advised her to report it to the Police Station but she told him she could not do that because if she did, it would be like she is reporting her own husband to the police. Maimuna said the accused person divorced her because he said she did not heed  his advice.

She said everything she said in court is the truth, saying if not then why the accused write a divorce letter to her?

She said after divorcing her, the accused person and his other wife left the house they were in and he (the accused person) never brought anything for their kids since he divorced her.

During the cross-examination, Maimuna maintained that she built the house in the compound they were living from her own money.

The matter is now adjourned to 18th August for continuation of Cross-Examination.
