Principal Magistrate Hilary Abeke of the Kanifing Magistrates’ Court, last Tuesday ordered one Dawda Kundu to compensate Abdou Dampha, his assaulted victim with the amount of D8, 000 for injuries that the complainant sustained.
The magistrate made the order following Kundu’s plea of guilty to one count charge of assault causing grievous harm to Abdou Dampha. Kundu is said to have caused serious injuries on the ear and palm of the victim with a cutlass. In addition to the compensation, Kundu was also ordered to pay a fine of D2, 000.
According to the facts of the case as narrated by the prosecution, Abdou Dampha visited Kundu’s house to mediate for a marriage between his (victim) brother and the sister to the accused.
The prosecutor explained that while on that process of discussing with the accused person’s mother, quarrel erupted between the victim and the accused, adding that the accused person then took a cutlass which he used to cause the injuries on the victim’s ear and palm.
He added that the matter was reported to the Bakau police station and the victim was escorted to the Serekunda Hospital and later referred to the Edward Francis Small Teaching Hospital (EFSTH) in Banjul. He said the accused was later arrested and charged accordingly.
Both Lawyer Edu Gomez and Pa Harry Jammeh had pleaded for court’s mercy on behalf of the accused person.
