Court Orders for EFSTh to Release Alleged Murderer’s Medical Report




Justice O Ottaba of the High Court in Banjul last Wednesday made an order for the medical report of one Francis Saine, an accused person charged with murder, to be released by the Edward Francis Small Teaching Hospital.

The order was directed to the Chief Medical officer of the hospital, requesting him to ensure the medical report of the accused person is forwarded to the court on or before the next adjourned date.

Francis is charged with murder in which he is alleged to have caused the death of Eli Ndene by hitting her on the head, knowing that death would be the probable consequences of his act. He is said to have committed the alleged crime on or about 11th November 2015 at Kunkujang in the West Coast Region within the jurisdiction of the court.

Justice Obata’s decision came following defence counsel S. Gaye’s application for the medical report to be produced.

Counsel Gaye recalled that on 14th July 2016, the court had ordered for his client to be mentally examined and he was taken to the EFSTH where the examination was conducted on him but the report has not been made available to the court.

To that effect he applied for the court to order for the hospital’s Chief Medical Officer to forward the report to the court. This was granted by the court.

The case is adjourned to 26th October 2016 for report to be produced to the court.
