Police prosecutors yesterday filed a charge of rash and negligence driving against one Lamin Fadera, a pick-up vehicle driver before a Kanifing Magistrates’ Court.
Under trial before Principal Magistrate Hilary Abeke, Fadera is accused of driving the car with registration number: BJL 8590 L on 13th November 2016 along the Banjul-Brikama Highway around Sting Corner in a rash and negligence manner and caused the death of two people.
The accused person who was in physical pain with his left hand on bandage had denied responsibility of the charge.
The accused made a bail application through his defence lawyer pursuant to Section 99 (1) of the Criminal Procedure Code (CPC), saying the offence is bail able one. The defence counsel also reminded the court that the accused has suffered serious injuries as a result of the accident, leading to his hospitalizing for a week.
The defense counsel added that the accused has been in police custody after he was discharged from the hospital.
Without objection from the police prosecuting officer, Sub-Inspector Trawally, the court granted bail to the accused person in the sum of D500, 000 with two Gambian sureties who must deposit their national identity cards to the court and swear to an affidavit of means.
The case is adjourned to 5th December for hearing.
