A man who was facing a charge of threatening violence have been acquitted and discharged by Magistrate Muhammed Krubally at the Bundung Magistrates’ Court.
Magistrate Krubally freed Abdoul Karim Jabang for what he called the prosecution’s failure to convince the court that Jabang had truly committed the alleged crime.
Mr Jabang was accused of threatening one Keith Deathridge with violence on 16th April 2016 at Brufut. He had denied responsibility of the charge since the beginning of the trial.
In his judgment, Magistrate Krubally said upon careful examination of the charge against Jabang, prosecution witnesses’ statements, cross-examinations and Jabang’s only statement in defence made him to formulate only one issue; that is whether the prosecution had proved a charge of threatening violence under Section 284 of the Criminal Code.
He said in view of the charge pressed against Jabang, coupled with the prosecution’s testimony, could not made him to convict Jabang. He said the facts presented before him fell far short of the minimum core being contemplated in Section 284 of the Criminal Code.
Magistrate Kruballly said under such a circumstance, the court held that the prosecution has failed to discharge the burden of proof. “I therefore discharge and acquit the accused.”
