One convicted, another acquitted in Super Bar theft case



Magistrate Pa Modou Njie of the Bundung Magistrates’ Court has convicted Alasana Saho and acquitted Abdoulie Aziz Nying, two of the men who were involved in a theft case at Super Bar in September 2015.

The two were said to have stolen D90, 000 from one Shiekh Omar Jack. The police arrested them in connection to the theft and were slammed with two criminal charges of conspiracy and stealing.

After a one year legal tussle with police prosecutors, the court found Alasana Saho guilty of the charges but said Abdoulie Aziz Nying was innocent of the crime.

Magistrate Njie said from the totality of the evidence presented, there was no evidence establishing or suggesting that the two met and discussed to steal. The senior magistrate pointed out that the police have failed to prove the first count of conspiracy.

He said Saho was acquitted on conspiracy charge but convicted on stealing. He said Nying was acquitted and discharged on both counts.

Magistrate Njie sentenced Alasana Saho to six months mandatory jail term and a fine of D6,000 in default to serve 6 months imprisonment. He also ordered for Saho to pay a compensation of D90,000 to the complainant in default to serve 2 years imprisonment.
