PW1 Testifies in False Pretence Case




Dodou Sarr, a resident of Sukuta Monday Testified as First Prosecution Witness (PW1) in a single count charge of obtaining money by false pretence involving Ongoing Naffia Sambou, Kemo Cham and Lait Bordner before Magistrate Pa Modou Njie, at the Bundung Magistrates’ Court.

Kemo Cham, Naffie Sambou and Lait Bordner are accused of conspiring among themselves in Bijilo and diverse places and obtained D250, 000 from Omar Cham and Dodou Sarr and D635, 000 from Ebrima Jaiteh with the pretence of selling a compound to them which was found to be false.

In his testimony, the witness told the court that in the month of July, this year, the first accused person Kemo Cham met him and the complainant (Omar Cham) about a land he wanted to sell.

He said the complainant; who is currently in Germany, expressed interest in the land and they all went there in Bijilo. He said when they reached at the land, the accused revealed to them that he do not own the land but Naffie Sambou, the 2nd accused person owned it, saying they should go and meet her to negotiate.

The witness added that after negotiation, the 2nd accused person and the complainant agreed on a selling price of 1.5million dalasi but the second accused said she did not have the required transfer documents so she will need the complainant to deposit some money so that she can prepare the documents for the land.

According to the witness, the complainant gave her D250, 000 as deposit for the land but they agreed that the complainant will be sending the rest of the money through the first witness.

The witness explained that after some time, they receive a report that there were some people constructing on the land.

He said when he (witness) confronted the second accused person, he told him that she sold the same said land to someone else but he still continue to follow her to pay back the money they paid to her on several occasions, which she never did.
