One Buba Sanneh a resident of Brikama Darsilami and a student on Wednesday testified as the first prosecution (PW1) in the ongoing theft trial against one Ebrima Kah before Magistrate Isatou Janneh of the Brikama Magistrates’ Court.
The witness in his testimony told the court that on the 13th August 2016, he went to collect his result as he had his phone and money in his back pocket while the accused person was behind him, he realized the accused person putting his hand in his pocket.
He further told the court that he then turned back and saw the accused person and he quickly grabbed his hand and asked for his mobile which led to a push and pull between them. He added that the mark of the said mobile phone is Samsung and the colour is red after which the police prosecutor applied to tender the mobile in evidence and it was admitted and marked as exhibit A.
The witness continued to narrate that he was trying to take the accused person to the police station but he resisted but people came and helped him while he rushed to Brikama police station to call the police.
Upon their arrival at the police station, the witness said he made his complain and the police ask him to wait for a while because the accused was drunk and he later asked to give a statement.
While responding to questions from the accused person during cross examination the witness told the court that the accused person stole his phone and when he caught the accused person, they were pushing and pulling but he was not beaten as claimed by the accused in his testimony.
According to him, at the police station the accused person confessed that he stole the mobile phone and the money.
The accused person is alleged to have on or about the 13th August 2016 at Brikama market in the kombo central district, he stole a Samsung mobile phone valued at D450 and cash of D500 being the property of Buba Sanneh.
The matter was adjourned to 28th September 2016.
