One Ndey Njie, yesterday appeared before Acting Principal Magistrate Kebba Baldeh of the Banjul Magistrates’ Court to answer to a charge of murder leveled against her by the police.
It is alleged that the woman on or about 2nd September, 2016 at Mbolletba village in North Bank Region of the Islamic Republic of The Gambia, intentionally and unlawfully chop her husband’s neck with an axe resulting to the death of her late husbanhd Ma Wally Faye. She denied allegation after the charge was read over to her, however the police prosecutor Corporal H Jobe made an application under section 68 of the Criminal Procedure Code (CPC) for the case to be transferred to the high court for trial as the lower court lacks the jurisdiction to entertain the case.
The presiding magistrate went on to transfer the case to the high court in Banjul stating that his court lacks jurisdiction to hear the case.
