A Police Prosecutor at the Kanifing Magistrates’ Court yesterday applied for withdrawal of a charge of obtaining money by false pretence against Ousman Jatta and Amat Sowe on the grounds that the accused persons and two others are jointly facing similar charges with the same statement of facts and particulars.
Prosecutor Sergeant Jaiteh told the court, presided over by Principal Magistrate Hilary Abeke that his application for the withdrawal of the charge against the two is in line with Section 68 (1) of the Criminal Procedure Code (CPC).
The presiding magistrate granted the prosecutor’s application and said by order of the court and the withdrawal application made by the prosecutor pursuant to Section 68 (1) of the Criminal Procedure Code (CPC), the accused persons are acquitted and discharged of the offence charged.
The accused persons will now face a similar charge with Babucarr Khan and Pa Omar Bojang, another two accused persons.
By false pretence and with intent to defraud, Ousman Jatta, Amat Sowe, Babucarr Khan and Pa Omar Bojang are accused of obtaining the sum of D555, 000 from Telleh Baldeh, Abdurrahman Jallow, Omar Bass, Modou Leigh and Jukay Gaye on the pretext that they were going to attend a Scout Jamboree in different parts of Europe which they knew was false. They are said to have committed the offence between the years 2012 and 2014 in Bakoteh.
