Magistrate Pa Modou Njie of the Bundung Magistrates’ Court has convicted two drug peddlers to pay a fine of D100, 000 each in default to serve one-year imprisonment.
Magistrate Njie made this decision after the court was satisfied that the prosecution had established a case against Nasirou Bayo and Assan Dondeh.
Handing down his sentence, the magistrate said he relied on the evidence of the prosecution, the 1st, 2nd and 3rd prosecution witnesses to levy the sentence.
He affirmed that the evidences of the prosecution witnesses were consistent and unequivocal and since the court did not believe in Bayo and Dondeh’s version of what had transpired, the court would hold that the prosecution has proved the charge against both convicts beyond reasonable doubt.
Nasirou Bayo and Assan Dondeh were standing trial for the possession of 180 grams of Cannabis sativa, which contravenes Section 35(2)(b) of the Drug Control Act 2003 (as amended) Cap 10:01 Volume 3 of the revised laws of The Gambia.
